Requesting Therapy Records
Your privacy is important to us. We comply with HIPAA and Texas law regarding the use and release of mental health records.
How to Request Records
Clients may request copies of their therapy records by submitting a written request along with a signed Authorization for Release of Protected Health Information. Requests may be made by the client or a legally authorized representative.
Record Availability
In accordance with Texas law:
Treatment records may be released with proper authorization.
Psychotherapy notes are not released, except as permitted by law.
Certain information may be limited or withheld if disclosure could reasonably be expected to cause harm.
Processing Time & Fees
Requests are typically processed within 15 business days of receiving a complete request. Reasonable fees may apply for the preparation or copying of records, as allowed by law. Any applicable fees will be communicated in advance.
How Records Are Delivered
Records may be provided securely via encrypted email, secure patient portal, fax, or paper copy upon request ($.25 per page fee).
Subpoenas & Court Orders
We do not release therapy records in response to a subpoena without a valid client authorization or a court order signed by a judge, as required by Texas law. Subpoenas, court orders, or legal requests should be submitted in writing and will be reviewed for legal sufficiency prior to any release of information.
Third-Party Requests
Requests from attorneys, insurance companies, or other third parties require a valid written authorization from the client or a court order.
